Why is this new legislation so important? The term “workplace stress” took on a whole new significance, with new obligations for employers, and potentially serious financial consequences for those who ignore them. Workplace stress is no longer simply a sad fact of life. It is now an officially recognised and legislated “workplace hazard”, with the amendments extending the definitions of “harm” and “hazard” to include physical and mental harm caused by work-related stress. A cursory reading of the new legislation might be enough to instantly treble employers workplace stress, but a deeper understanding goes some way to restoring mental equilibrium. The Occupational Safety and Health booklet, Healthy work, Managing Stress in the Workplace, tells employers that “there is only a requirement to manage work stressors or the individuals stressed situation where you can be reasonably expected to know about the stress. Even then the obligation is only to do what is reasonably practicable in the circumstances.”

Stock markets look as unpredictable now as they did last year at this time. As before, you cannot go wrong by gradually easing into the market by buying stocks that provide value and by buying ETFs to eliminate additional risks. As we keep emphasizing, our aim should be two-fold: to preserve our capital and then to maximize our returns. When you invest in an ETF or an index fund, most investment risks — not all — are eliminated. The most significant feature of index investing is this: You will never do better than the index in good times and you will do as bad as the market in bad times. This is not as bad as it sounds. First, if you look at the track record of mutual funds here and in the U.S., you will see that very few mutual funds have performed better than the indices consistently. So, if we can do as well as the indices, we will be further ahead of most investors. Second, during the bad times our performance will be as bad as that of the market. This is known as market risk and index investing is fully exposed to this risk. But since, over the long term, the trend of equity indices is up (and also because there is no guarantee that you can do better by directly investing in specific stocks or mutual funds), index investing is still a relatively safe way to invest, especially if you are a long-term investor. Furthermore, you can redu ce your market risk by investing in different ETFs that contain different investments. For instance, ETFs are available not only for stocks, but also for other investments such as bonds. By holding a variety of ETFs, you can reduce the market risk associated with one particular type of investment.

William Jefferson, D-New Orleans, said he has voted in favor of the American Housing Rescue and Foreclosure Prevention Act of 2008, which he says will help Louisianas recovery from the 2005 hurricanes. “Louisiana will benefit tremendously from” the act, he said. “Within this act, an affordable housing fund is created, and in the first year alone, Louisiana will be the recipient of 75 percent of the funds, $375 million, to encourage the development and rehabilitation of affordable housing. One of the survivors of a coach crash in Turkey which killed three British tourists arrived home last night for treatment for chest injuries. The middle-aged man was admitted to Glasgow Royal Infirmary, where a spokesman described his condition as “serious but stable”. A second British survivor, who had been expected to fly to Glasgow, was taken instead to hospital in Graz, Austria, after her condition deteriorated while the air ambulance made a refuelling stop. Its not every day you see the pick-up variety of limousines. But according to Brad Hollar, president of Accente Limousines, theres a need for the 20-passenger vehicle with a bed in the back. We live in Oklahoma and half the people here have pick-up trucks, Hollar said of the $125 to $150 an hour ride. A company in California custom-made the $80,000 vehicle that Hollar claims is the only one of its kind in the Oklahoma City area. Weve only had it for about 60 days. Martial arts expert Steve Bindon told yesterday how he severed three fingers when a Samurai sword demonstration went horrifically wrong. He was arrested on suspicion of two counts of lewd acts with a minor, which are felonies, and annoying or molesting a child, a misdemeanor.

Spiceworld - The Movie (PG) Forget Arnie, Sly, Demi, Disney or even that Cruise geezer. With Christmas wrapped and their chart-busting Too Much predictably slotted in at No. 1, a very timely debut dose of big- screen Girl Power succeeds the Full Monty as this year-ends British film biggie.
Snobbishness and condescension ooze from every sentence of Mr. Douthats essay, and his one-size-fits-all dismissal of the films screened at the American Film Renaissance festival (the festivals movies were often awful in fascinating ways, but they were awful nonetheless) strikes me as typical liberal shallowness. How could he make such a blanket statement if he had seen the excellent documentary Entertaining Vietnam, a film that has won best-documentary awards in multiple film festivals around the U.S.? And it appears he did not take the time to see our documentary, Silent Victory (which has received positive reviews from audiences liberal and conservative), before painting us with the same negative brush. Not only that, but apparently Mr. Douthat felt he had to make snide remarks about the physical characteristics of festival founders Jim and Ellen Hubbard (bouffant hair, heavyset man with a hangdog air). Of what relevance could his opinion of what they look like be to the content of the films in the festival?

The big, hot flights have given way to small flocks of birds flowing from nesting areas to feeding fields to water. You set up a few dove decoys in the bare branches of a small tree somewhere in the flight path. Then in full camouflage, you lie down on your back looking up at the decoys and with pistol in hand, take a crack at the incoming birds. With a chamber that accepts either .45 Colt or 2 1/2″ and 3″ .410 shotshells, the T/C Contender barrel, rifled though it is, turns in stellar performance as a .410 shotgun if the ranges are kept within 20 to 25 yards. It is the nature of expectations about family relationships, and the extent to which the values that are incorporated in family law coincide with these expectations, that is the subject of this rich collection of 18 essays edited by Maclean. Like the previous two volumes on family law that Maclean edited, this one is also based on meetings held at the International Institute for the Sociology of Law in Onati, Spain and, like its predecessors, the approach here is interdisciplinary and its scope is European and North American. The book is divided into five sections. The first presents different approaches to the study of the nature of family values alongside those values put in place by legal systems; the next three chapters deal with the regulation of the relationships between adults and children, adult couples, and adult children and elderly parents, respectively; while the final chapter deals with diversity and standardization in family values and family law.
Simply put, the intention of this legal reform is to simplify the law and to improve accessibility for all by streamlining procedures in response to the public. Alberta Justice, through its Family Law Reform Project, initiated a review of all provincial family laws following a series of public consultations, primarily in Edmonton and Calgary. Family law problems are inherently complicated and in Alberta, in addition to legal issues, procedural issues–both systemic and jurisdictional–have long frustrated efforts to resolve cases. Some family law problems, such as divorce, spousal support, and child support, are matters of federal jurisdiction, governed by the laws of Canada. Others, such as the division of matrimonial property and custody or access orders in non-divorce or common-law situations, are said to be matters of local and provincial concern and are governed by provincial laws. While legislative jurisdiction is a topic that does not really interest anyone other than lawyers, it is something that, in Alberta at least, has confused and frustrated members of the public, since it determines which court deals with which issues. As a rule, matters arising from federal statutes must be dealt with in courts of superior jurisdiction–in Alberta, this is the Court of Queens Bench–while matters arising from provincial legislation are generally, but not exclusively, matters for the lower level provincial courts. For years, the public has had difficulty determining which court is the appropriate court for a particular problem. So says a Light Reading survey, which it launched after hearing that Alcatel appointed Alan Mottram as its new CMO, replacing the retiring Ron Spithill. It seems that Mottrams name (as president of Alcatels fixed solutions division) generated almost twice as many Google hits as Spithill (score: 996 to 499). What does all this mean? Editors Synopsis: The author examines how changes to the Uniform Commercial Code Article 9 relating to promissory notes secured by real estate mortgages may affect priority disputes between secured parties and the Internal Revenue Service. This analysis proceeds upon the following basic assumptions: First, the holder of a note and mortgage may transfer that holders rights in the instrument by a document of assignment without a physical delivery of either the note or mortgage. This concept is implicit in the Article 9 provision for automatic perfection of an absolute assignment of a promissory note.6 Otherwise, because possession is also a method of perfection,7 the provision would be superfluous. Second, attachment (i.e., creation) of a security interest8 in Article 9 collateral, including a promissory note, requires either (1) a security agreement authenticated by the debtor, or (2) possession of the collateral by the secured party pursuant to an agreement.9
As I prepared to write this article, the supply of capital for income producing real estate investments was reliably strong and abundant. Our capital markets/CMBS lenders were active, our local banking community was competitive and actually experiencing a healthy increase in market value; money continued to chase deals (albeit a little more cautiously) and supply seemed to out-strip demand. Although no one knows for sure how these events will affect the real estate finance market over the long run, we are hopeful that our lending community will continue to act objectively with prudence as they evaluate and underwrite our loan applications. Indeed, I can tell you that the lenders Ive spoken with during the weeks following the attack generally believe that the New York real estate market possesses a strong fundamental foundation and demand for commercial space as well as ownership and rental apartments will continue under normal market conditions. Contrary to what one might expect during such times of uncertainty, no lending source has developed a doomsday attitude towards real estate. In fact, several lenders actually see the potential for a stronger market to emerge with isolated positive opportunities. Suddenly there is a huge demand for more office space, more construction services, more desks, phones, computers etc. The flip side is, of course, that tourism will be down in the near term, food services will suffer, entertainment dollars will go elsewhere and more people may stay at home and restrain their spending habits.
During the past six months, real estate executives in New York City have been in a battle of perception. A picture of declining rental rates, climbing vacancies and tenants returning space in droves has been at the forefront of many recent news articles. However, the fact is that New York Citys real estate market is not as weak as many believe. In fact, the citys residential market has shown signs of stabilizing and many neighborhoods are on the upswing. Currently, we are seeing rental rates begin to stabilize to the levels posted during the summer of 2001. We must always keep in mind that New York City still has some of the best restaurants, retailers and destination spots in the world, making it the perfect live/work/play city. Its no wonder then that people still want to call New York City home. In addition to renewed tenant demand in New York City, the job market is also beginning to show signs of recovery. Financial institutions, with a major presence in the city, are once again looking to hire quality employees. As a result, the market is poised to see a new generation of residents by the fall of 2002 and beginning 2003.

Chelators added to pectinase-rich enzyme mixtures increase the efficiency of enzyme retting of flax. The multitude of available chelators requires research to optimize enzyme retting for cost and fiber quality. Of several chelators tested, ethylenediaminetetraacetic acid (EDTA) is the most effective in sequestering calcium from solution, with substantial activity even at pH 4 or 5. Phosphate is also effective, but only at high pH. EDTA and Mayoquest 200, a commercial product with -37% EDTA, in combination with Viscozyme L or Lyvelin, commercial enzymes with polygalacturonase activities, yield high Fried test scores, indicating efficient separation of fibers from core tissues. Neither chelator nor enzyme at the levels tested alone effectively rets flax at a pH of around 5. In contrast, EDTA at 20 mmol/L levels and alkaline pH yields high Fried test scores. The addition of BioPrep, a commercial pectate lyase, does not influence retting measured by the Fried test with EDTA at alkaline pH, but the enzyme does improve retting with the weaker chelator sodium tripolyphosphate. The quality of fibers, as determined by the yield of fine fibers obtained by passing retted flax through the Shirley analyzer, is substantially greater with EDTA plus Viscozyme at pH 5 than alkaline chemical retting with EDTA, sodium tripolyphosphate, or sodium oxalate without enzyme. EDTA is the most effective chelator at acidic pH levels for stimulating flax retting by various commercial pectinase-rich enzyme mixtures. However, other less expensive candidates require additional study for more cost-effective formulations and applicable fiber properties. Retting is the process by which fibers in flax (Linum usitatissimum L.) stems and other bast plants are separated from the nonfiber tissues. This process, which is usually microbial, is the major limitation in producing linen fibers [25]. For commercial flax fiber operations, flax stems are pulled from the ground and dew retted, in which indigenous fungi colonize and degrade the nonfiher tissues to liberate fibers. After dew retting, the stems are mechanically cleaned to remove shive and other contaminants from fibers for use in linen yarns and fabrics. While currently the method of choice, dew retting is restricted to geographical regions with appropriate climates, and the resulting fibers are often inconsistent in quality with significant amounts of dirt and contaminants [21, 25]. Therefore, considerable research has focused on alternative chemical and enzymatic methods to improve the consistency of fiber quality [1, 4, 5, 9, 10, 14, 21, 22, 25]. Increasing U.S. interest in flax fibers for use as cottonized fibers in textiles [4] and for bio-composites [19] globally provides a strong impetus to improve flax retting. The importance of pectin as a binder between cells and the necessity to remove it during retting has been acknowledged for several decades [25]. Therefore, pectinases, and in particular endopolygalacturonases, are effective in retting flax [2, 4, 11, 12, 17, 25, 26]. However, pectin is a complicated polysaccharide that varies in structure [16]. In nonmethylated pectins, often Ca2+ binds carboxyl groups of adjacent molecules, thus stabilizing pectins and thereby plant structure [20]. In flax, recent research has indicated that acidic pectins and Ca2+ are located preferentially in the epidermal regions of flax [18], likely contributing to the structural integrity of the stem and bast fibers. Therefore, complex formers, e.g., chelators, such as ethylenediaminetetraacetic acid (EDTA) to remove Ca2+ have proven useful in retting flax and in facilitating enzyme retting [4, 7, 9, 11, 21].

Measuring instruments of the future will have to be up to six times more accurate than they are today and must live outside the PC. Thats what Keithley Instruments (Cleveland) found when it surveyed 301 process and test engineers recently. “Engineers in plants and design labs all see making rapid, repeatable measurements as a critical technology,” says Michael Minneman of Keithley. As for speed, measurement systems must collect their data-without sacrificing resolution or sensitivity-without slowing the production line. Though only 23% of the engineers surveyed require more than 1000 readings/sec, 30.5% say they will soon need that speed, and 12% expect they will need speeds as high as 10,000 readings/sec. At these levels, its clear that computer-controlled devices will do most of the measuring.
Performance and measurement are two topics that many of us think of as being the same as water and air-without them, organizational life would not be possible. TIS THE SEASON of giving. For many, its also the season of credit card debt. Holiday shopping seems to come out of nowhere, catching shoppers financially unprepared for the extra expenses and turning to their credit cards. That leads to whats known as a “holiday hangover” in January, when consumers open up their credit card statements.
WASHINGTON (AP) — Many consumers have started to pay off their credit card debts more quickly and to resist taking new cards, helping reduce record-high personal bankruptcy rates, a consumer group said Tuesday. The Consumer Federation of America said 112,000 fewer people filed for and received bankruptcy court protection last year than in 1998, which it termed the largest one-year decline on record. “Consumers have increasingly just said `no to credit card solicitations,” Stephen Brobeck, executive director of Consumer Federation, said at a news conference. In addition, he said, many consumers with credit card debts have realized the importance of paying more than the minimum payment on their monthly bills and are sending heftier payments.
SAVING money on your credit-card bill can be as simple as switching to a new card company. It is not just a question of playing the field for the lowest interest rate or the lowest annual fee. Some card issuers will trim your overall level of debt if you transfer your credit card business to them, even if you are still in the interest-free period and not yet paying any interest on that debt. Midland Bank also offers a 5 per cent rebate on a balance transferred from a rival credit-card company. But this rebate is only available to people who are already paying interest on at least some of the transferred debt. If you are simply transferring a balance that has not yet attracted interest, there is no rebate. The maximum saving in moving to a Midland Access or Visa card is pounds 100. The Bank of Scotland runs a similar scheme for new customers who consolidate their credit and storecard debt on to one of its cards. A sliding scale offers a maximum saving of pounds 60, for debt transfers of pounds l,250 or more.

As your new president, I face a challenging task when it comes to speaking to you about school finance. Let me give you my dilemma. It is the end of the school year as I write this piece and I am reflecting on the uncertain state of school finances in coming months and what these financial challenges mean for us as school system leaders. You will share my frustration that as many as half the nations students may be directly shortchanged of the education they deserve, with the remainder not immune to the impact of belt tightening. As bad as that news is, last year at this time NCSL found 36 states with budget gaps. On the other hand, NCLB and IDEA could be funded retroactively, which would help make up for last years budget shortfalls that resulted from unfunded or underfunded mandates. If you are a school leader in one of the rare districts whose state legislature decided this summer to support quality education with adequate funding for all your schools, the future must look bright, so you can skip the remainder of this column. If youre not in that sunny camp, please continue and let me share my thoughts.
